Hypnobirthing Class Terms and Conditions

Terms and Conditions – Hypnobirthing Classes (Raw Birth in affiliation with Hypnobirthing Australia™)
By enrolling in and attending a Hypnobirthing class facilitated by **Raw Birth**, you acknowledge and agree to the following terms and conditions:
1. General Information Disclaimer
All content provided during classes, whether written, verbal, audio, or video, is for general informational and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment. While every effort is made to ensure the information is accurate and up-to-date, no guarantees are made.
2. Medical Advice
You are encouraged to consult with your primary health care provider (e.g., obstetrician, GP, midwife) before making any decisions regarding your pregnancy, birth, or postpartum care. Participation in a Hypnobirthing class does not replace the advice or guidance provided by your medical care team.
3. Liability Waiver
Neither **Raw Birth**, **Hypnobirthing Australia™**, nor any of their affiliates, facilitators, or representatives shall be held liable for any direct, indirect, incidental, or consequential damages, injuries, complications, or losses arising from your participation in the classes or reliance on the materials provided. You participate in these classes voluntarily and accept full responsibility for your choices and outcomes.
4. Results Disclaimer
Hypnobirthing does not guarantee a particular birth outcome. Every birth is unique, and many factors influence labour and delivery. The techniques taught aim to support a calm, positive birth experience, but outcomes can vary.
5. Intellectual Property
All course materials provided, including handouts, audio tracks, videos, and scripts, are the intellectual property of Hypnobirthing Australia™ and/or Raw Birth and are for personal use only. You may not copy, share, record, reproduce, or distribute any part of the course content without written permission.
6. Class Attendance and Participation
You are responsible for attending scheduled sessions. Refunds or transfers are not guaranteed for missed sessions. Your active participation and completion of assigned exercises and home practice are essential to achieving the best results.
7. Payment and Refund Policy
Payment for classes must be made in full prior to the commencement of the course. Refunds may be offered in exceptional circumstances at the discretion of Raw Birth. No refunds will be provided for change of mind or failure to attend without notice.
8. Privacy
Any personal information collected during registration or class participation is kept confidential and used solely for the purposes of delivering the hypnobirthing program. Your details will not be shared with third parties without your consent, except as required by law.
9. Amendments
Raw Birth reserves the right to make changes to the course content, schedule, or these Terms and Conditions at any time. Any significant changes will be communicated in advance where possible.
By registering for and attending a Hypnobirthing class with Raw Birth, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

Birth Toolkit Terms and Conditions

Introduction(a) These terms and conditions govern the agreement between you and Raw Birth (ABN 99802718224) ("we", "us", "our") and supersede any previous representations and communications.(b) Your hire of equipment from us, whether through our website or otherwise, is subject to these terms and conditions ("Terms").
Equipment Hire(a) By hiring birth equipment from us, you agree to these Terms.(b) The equipment remains the property of Raw Birth at all times.(c) Equipment hire is subject to availability and your acceptance of these Terms.
Responsibilities of the Hirer(a) It is your responsibility to:i. Test and familiarize yourself with the equipment upon receipt.ii. Use the equipment strictly in accordance with provided instructions and guidelines.iii. Inform us immediately of any issues or concerns regarding the equipment.iv. Use the equipment responsibly and in accordance with all safety instructions and contraindications provided.v. Obtain approval from your medical practitioner for the use of the equipment, where necessary.vi. Return the equipment and all accessories in the same condition as received, normal wear and tear excepted.
Use of Equipment(a) The equipment is intended for use during pregnancy and birth and must not be used for any other purpose. (b) We do not guarantee the success or outcome of using the equipment as effectiveness may vary depending on individual circumstances.(c) Equipment must not be used under certain conditions as outlined in the provided instructions and contraindications.
Hire Period and Returns(a) The hire period commences upon receipt of the equipment and ends on the agreed return date.(b) You are responsible for returning the equipment by the specified return date. Late returns may incur additional charges or fees.(c) Extensions to the hire period may be available upon request and subject to availability.
Damage or Loss(a) You are liable for any damage to or loss of the equipment during the hire period.(b) If the equipment is damaged beyond normal wear and tear or lost, you agree to compensate us for the replacement cost of the equipment.
Assumption of Risk:(a) The use of equipment provided by Raw Birth involves inherent risks, and by renting or using the equipment, the renter assumes all risks and liabilities associated with its use.
(b) It is the responsibility of the renter to fully understand how to operate the equipment safely. Instruction manuals and safety guidelines will be provided and must be followed at all times.
Waiver of Liability:a) To the fullest extent permitted by law, Raw Birth and its affiliates, officers, directors, employees, agents, and representatives (collectively referred to as "the Company") shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the equipment.
b) This includes, but is not limited to, damages for personal injury, property damage, loss of profits, loss of data, or any other loss arising out of or related to the use of the equipment.Indemnification:(a) The renter agrees to indemnify and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to the renter's use of the equipment.(b) This indemnification obligation shall apply even if the claim arises from the negligence or fault of the Company.
Equipment Condition:(a) The equipment is provided in good working condition. It is the responsibility of the renter to inspect the equipment upon receipt and notify the Company immediately of any defects or concerns.(b) The Company makes no warranties, express or implied, regarding the condition or fitness for a particular purpose of the equipment.
Cancellations and Refunds(a) Cancellations made before the dispatch of equipment may be eligible for a refund less an administration fee.(b) No refunds will be provided once the equipment has been dispatched unless required by law.Limitation of Liability(a) To the extent permitted by law, we exclude all warranties and liabilities in connection with the hire of equipment, except where such exclusion is prohibited by law.(b) Our liability for any breach of these Terms or in connection with the hire of equipment is limited to the hire fee paid by you.
Privacy(a) Any personal information collected from you will be handled in accordance with our Privacy Policy.
Governing Law(a) These Terms are governed by the laws of [Your State/Country].Amendments(a) We reserve the right to amend these Terms at any time without prior notice.
Security Deposit:(a) A security deposit is required for all equipment rentals. The amount of the deposit will be specified in the rental agreement or communicated prior to rental commencement.(b) The security deposit is refundable upon return of the equipment in satisfactory condition, less any deductions for damages, late fees, or additional charges incurred during the rental period.(c) The deposit will be processed using the credit card on file unless otherwise agreed upon in writing.
Credit Card on File:(a) A valid credit card must be provided and kept on file for the duration of the rental period. The card will be used for processing the security deposit, rental fees, and any additional charges accrued.(b) By providing a credit card for payment, the renter authorizes the rental company to charge the card for any outstanding balances or fees incurred during the rental period.(c) The credit card information will be securely stored and used solely for the purpose of processing rental transactions and related charges.
By signing the rental agreement or providing credit card information, you acknowledge and agree to these terms and conditions.
